The matter comes upon for consideration of the interlocutory application preferred on behalf of the applicants with a prayer to condone the delay of 101 days in filling the connected appeal.

Mr. M.H. Ahmed, learned counsel for the applicants has submitted that the delay has been properly explained in the interlocutory application. It is also Page No.# 3/3

submitted that in an identical appeal against the impugned judgment, i.e. Writ Appeal No.324/2023, this Court, while admitting the same, has pleased to issue notices to the respondents.

Mr. B.K. Das, learned counsel appearing for the respondent No.2 has vehemently opposed this application and has submitted that the delay in filing the connected appeal has not been explained satisfactorily. The learned counsel has placed reliance on a decision of the Hon'ble Supreme Court rendered in V. Nagarajan -Vs- SKS Ispat & Power Limited & Ors., reported in (2022) 2 SCC 244.

Having heard the learned counsel appearing for the parties and after going through the contents of the interlocutory application and also taking into consideration the fact that against the impugned judgment one writ appeal has already been admitted, we deem it appropriate to condone the delay of 101 days in filing the connected appeal. Hence, the interlocutory application is allowed. The delay of 101 days is condoned.

Registry is directed to register the connected appeal and list the same for admission after 2(two) weeks.

The interlocutory application stands disposed of.
