Heard Mr. I.U. Chowdhury, learned counsel for the appellant, who submits that the Judgment dated 25.07.2023 passed by the Court of the Addl. Sessions Judge-cum-Special Judge (POCSO), Amingaon, Kamrup in SPL.(P) Case No. 73/2018, by which the appellant has been convicted under Section 4 of the POCSO Act should be set aside.

Admit the appeal.

Ms. S. Jahan, learned Addl. PP appears for the State.

The service of notice to the respondent No. 2, who is the mother of the victim, should be issued through the IO/OC of the concerned Police Station.

The appellant shall submit a copy of the appeal to the Registry, who shall furnish the same to Ms. S. Jahan, learned Addl. PP. The Addl. PP shall thereafter transmit the same to the IO/OC of the concerned Police Station, who shall furnish the same to the respondent No. 2 and submit a report thereafter.

List the matter after 4 (four) weeks.
