Heard Mr. M. Dutta, learned counsel for the petitioner.
Pursuant to order dated 04.04.2023, Dr. Suranjana Senapati, the Director
of Elementary Education, Assam is personally present along with Mr. N.J.
Khataniar her learned counsel.
The learned counsel for the respondent no.4 has submitted that the
respondent no.3, namely, Dr. Bijoya Choudhury, the Secretary, Elementary
Education Department is unwell and prays for exemption of her personal
appearance.
In view of the submissions made, the personal appearance of the
respondent no.3 is exempted.
The learned counsel for respondent no.4 has submitted that against the
order dated 03.03.2017 passed in the WP(C) 268/2013, in respect of which this
contempt petition has been filed, was assailed in WA 355/2022, which has been
dismissed by order dated 20.02.2023. It is submitted that the State has
preferred a SLP against the said orders, which is now registered under a
particular diary number issued by the Registry of Supreme Court of India. It is
submitted that the matter be adjourned to enable the respondent to comply
with the order of this Court subject to whatever order that may passed in the
SLP filed by the respondents.

Although mere filing of the SLP before the Supreme Court of India would
not be a good ground to postpone the proceeding of this contempt petition.
Nonetheless, having regard to the fact that SLP has been filed by the Education
(Elementary) Department, Assam, the Court is inclined to adjourn this matter till
05.06.2023.
It is made clear that if the proceeding carried out against the judgment
and order dated 03.03.2017 passed in WP(C)268/2013 remains unfavorably to
the Elementary Education Department, the Court would proceed further in this
matter on the next date.
Till further orders, the personal appearance of the respondent nos. 1, 3
and 4 is dispensed with.
