Heard Mr. A.R. Agarwala, learned counsel for the applicant, and Ms. M. Choudhury, learned counsel for the opposite party.

It is submitted by Mr. A.R. Agarwala that 50% of the award deposited by the appellant may be released to the applicant/respondent. The learned counsel appearing for the opposite party/appellant submits that one of the grounds for challenging the impugned judgment and award in the appeal is that since there are two vehicles involved, there is a contributory negligence, therefore, the appellant alone should not have been made liable. And as such, in case 50% of the award is released it would amount to releasing the whole amount of the award, which would be the share of the appellant. The learned counsel also submitted that the appeal may be heard at the earliest instead of releasing the 50% of the award. Mr. A.R. Agarwala, learned counsel of the applicant submits that the award is only against the appellant and not against any other; therefore, the amount may be released to the applicant. He also submits that the applicant is ready to furnish Indemnity Bond in case the prayer is allowed.

Considering the submissions of both the learned counsels and taking into view the facts and circumstance of the case, this Court is of the view that the amount may be released since the applicant is ready to furnish Indemnity Bond. In that view of the matter the IA is Page No.# 5/5

allowed. Let the 50% of the award deposited to the Registry be released to the applicant, subject to furnishing of an Indemnity Bond.
