Heard the learned counsel Mr. S. Dutta appearing for the applicant/petitioner.

This is an application praying for modification of the order dated 29.05.2023 passed by this Court in CRP(IO)/155/2023.

In the aforesaid order, it was directed that "till returnable date, further proceeding of Misc. (J) Case No.32/2022 in T.S.(D) Case No.59/2022 pending in the court of the learned Additional District Judge, FTC, Dibrugarh, Assam shall remain stayed".

It has been submitted that this part of the order is required to be modified.

It is suggested that the aforesaid order should have been like this-

"Till returnable date, the judgment and order dated 20.02.2023

passed in Misc. (J) Case No.32/2022 in T.S.(D) Case No.59/2022 pending in the court of the learned Additional District Judge, FTC, Dibrugarh, Assam shall remain stayed".

The prayer of the petitioner is allowed.

The judgment and order dated 20.02.2023 passed in Misc. (J) Case No.32/2022 in T.S.(D) Case No.59/2022 pending in the court of the learned Additional District Judge, FTC, Dibrugarh, Assam shall remain stayed, till returnable date.

This order shall form a part of the order dated 29.05.2023 passed by this Court in CRP(IO)/155/2022.

The present I.A. (Civil) stands disposed of.
