This Court, vide order dated 17.03.2023, had directed the appellant to take steps within 3 days, for service of notice upon the respondent no.2 by registered post with AD.

Office Note dated 03.04.2023 shows that no steps have been taken by the appellant and as such, no notice had been issued to the respondent no.2.

In view of the above, the appellant is directed to take fresh steps, for service of notice upon the respondent no.2, by submitting the same to the Registry of this Court. Registry shall thereafter give the notice to be served upon the respondent no.2 to Ms. S. Jahan, learned Additional Public Prosecutor, who shall forward the same to the O.C of the concerned police station. The O.C. of the concerned police station shall thereafter serve the notice to the respondent no.2, who is the mother of the victim.

The present appeal has been filed by only one appellant i.e. Umakanta Singh, while the impugned judgment dated 23.02.2023 passed by the learned Court of the Special Judge at Jorhat, in Special Case No.29/2019, has convicted not only the present appellant, but one Basanta Patnayak.

Registry is to make a report as to whether Basanta Patnayak has filed any appeal against the impugned judgment dated 23.02.2023 passed in Special Case No.29/2019 and if the same has been filed, the status of the same should be mentioned.

List the matter on 08.09.2023.
