Heard Mr. M. Baruah, learned counsel appearing on behalf of Mr. D. Das, learned counsel for the applicant. Also heard Ms. M. Choudhury, learned counsel appearing for the respondent No. 1 and Mr. K.R. Das, learned counsel appearing on behalf of Ms. M. Bharati, learned counsel for the respondent No. 6.
As per office note dated 07.01.2022 notice has been served upon respondent Nos. 2,3 & 5.
This is an application under Section 5 of the Limitation Act, 1963 for condonation of delay of 77 days in filing the connected MAC Appeal against the judgment and order dated 16.03.2017 passed by the learned Member, MACT, Goalpara in MAC Case No. 172/2014.
The ground of delay has been shown in the petition. I have perused the same and found it satisfactory. On the other hand the learned counsel for the respondent has made no objection against the prayer of the petitioner.ew
Hence, the delay in filing the connected MAC appeal is condoned and the I.A.(Civil) is disposed of.
