This appeal has been preferred by one Manoranjan Hatibaruah from jail, who is not

represented by any counsel.

Accordingly, Mr. A. Ganguly, learned Amicus Curiae is appointed to assist this Court on

behalf of the appellant.

Appeal is admitted.

Mr. J. Das, learned counsel assisting Ms. B. Bhuyan, learned Senior Counsel and

Additional Public Prosecutor, Assam, accepts notice on behalf of the State of Assam.

By the impugned judgment and order dated 11.08.2022 passed in Sessions Case

No.172(J-J)/2018 by the Sessions Judge, Jorhat, 3 (three) persons, namely, 1. Sri Manoranjan

Hatibaruah (appellant herein), 2. Sri Subhash Dey and 3. Sri Pranab Batibaruah were

convicted under Sections 302/34 IPC.

It has been submitted that Sri Subhash Dey has also preferred a jail appeal i.e. Crl.A.

(J) No.104/2022 against the same conviction.

Accordingly, Registry shall ascertain as to whether any appeal has been preferred by

Sri Pranab Hatibaruah against the judgment and order dated 11.08.2022 passed in Sessions

Case No.172(J-J)/2018 and tag the same along with Crl.A.(J) No.104/2022 and Crl.A.(J)

No.106/2022.

List this matter after receipt of the LCR by showing the name of Mr. A. Ganguly, learned Amicus Curiae for the appellant.
