Heard Mr. G. Chamuah, learned counsel appearing for the applicant as well as Mr. K.K. Das, learned Addl. P.P. appearing for the State.

The applicant has filed this application under Section 5 of the Limitation Act, 1963 with a prayer for condonation of delay of 8 days. The applicant has preferred a revision petition against the judgment and order dated 05.08.2021 passed by the learned Addl. Sessions Judge, (F.T.C), Lakhimpur, North Lakhimpur in Criminal Appeal No. 25(2)/2019.

It is submitted that on 29.09.2022, the petitioner met with an accident and immediately he was admitted in Hospital and due to said incident, the delay has occurred.

Mr. K.K. Das learned Addl. P.P. appearing for the State has no objection if the delay is condoned.

Considering the submissions of both the parties, the delay of 08 days stands condoned.

Registry is directed to register the Criminal Revision Petition and list it accordingly.

With the aforesaid direction, this interlocutory application stands disposed of.
