Though Mr. M Khan, the learned counsel for the petitioner submits that the issue is covered by a Division Bench order of this court, the Accountant General, Assam has passed a communication dated 02.08.2021 denying the claim of the Page No.# 3/3

petitioner. The counsel for the respondent accordingly submits that the said order has to be challenged before an effective relief can be granted. However, Mr. Khan, the learned counsel for the petitioner submits that the order being contravention with a Division Bench judgment of this court, no separate challenge would be required.

The issue would require some deliberations.
