Heard Mr. R. Dev, learned counsel for the petitioner. Also heard Mr. S.K. Agarwal, learned counsel for the respondent No. 1 and Ms. B. Bhuyan, learned Additional P.P. for the State respondent No. 2.

Pursuant to the Order dated 21.12.2021, both the parties remained present in the Court today.

It is submitted at the Bar that the matter has amicably settled between the parties and the petitioner has paid a sum of Rs. 2,30,000/- to the respondents. An affidavit to this effect has also been filed by the petitioner along with one deed of settlement which is enclosed with the affidavit as Annexure-A. A cursory perusal of the same reveals that both the parties have settled the matter amicably and they are no longer willing to proceed with the matter and therefore contended to close the same.

In terms of the affidavit, dated 22 September, 2021 and as agreed by the parties and in view of the submission advanced by the learned Advocates of both sides and also in view of the fact that the parties have settled the matter amicably and no longer willing to proceed further, this revision petition stands disposed of at the admission stage itself, by setting aside the impugned judgment and order passed by the learned JMFC, First Class dated 17.05.2018 in NI Case No. 789/2017 and affirmed by the learned Additional Sessions Judge (FTC) No. 4, Kamrup (M) in Criminal Appeal No. 88/2018 vide judgment and order dated 09.07.2019.

The parties have to bear their own cost.
