Heard Mr. M. Dutta, learned Amicus Curiae.

This is an appeal against the Judgment and Order dated 19.03.2010 passed by the learned Special Judge, Darrang Mangaldai in Spl. (N) Case No. 7 of 2007 convicting the accused appellant under Section 20 (B)(II) (B) of the NDPS Act Page No.# 2/2

and sentencing him to undergo rigorous imprisonment for four years and to pay fine of Rs. 25,000.00 in default R.I. for one year under Section 20(B) (II) (B).

Such judgment and order was passed on 19.03.2010 and there is no stay operating in the present application.

In that view of the matter, learned Amicus submits that the person might have in the meantime released from the jail.

Be that as it may, this Court request Mr. B. Sarma, learned Additional Public Prosecutor, State of Assam to have the instruction.

List this matter for hearing on 17.08.2022.
