Mr. A.L. Mandal, learned counsel representing the applicant-appellant. Ms. S.H. Bora, learned Additional Public Prosecutor, represents the State respondent.

This interlocutory application has been filed by the applicant-appellant seeking condonation of delay of 13 days in preferring the connected criminal appeal against Page No.# 2/2

the impugned judgment and order, dated 07-01-2020, passed by the learned Additional Sessions Judge/Special Judge, under the NDPS Act, Karbi Anglong, Diphu, in NDPS Case No. 01/2006, convicting and sentencing the accused-appellant under Section 20(B) of the NDPS Act to suffer rigorous imprisonment for 10 years and to pay a fine of Rs.20,000/- with default clause.

Since the appeal is a statutory one, in the considered view of this Court and as agreed to by the learned Additional Public Prosecutor, the delay in preferring the connected appeal is condoned after considering the statements made in the application as well as hearing the learned counsel for the applicant.

Registry to register the connected criminal appeal as well as the interlocutory application seeking bail and list the matters before this Court for orders. The interlocutory application stands disposed of accordingly.
