Heard Ms. R.D. Mozumdar, learned counsel for the appellant.

The appeal has been preferred under Section 173(1), Motor Vehicles Act, 1988 against the judgment and award dated 17.03.2021 passed by the learned Member, Motor Accident Claims Tribunal, Golaghat ("the Tribunal" for short) in MAC Case No. 41/2015. By the said judgment and award, the learned Tribunal has awarded an amount of Rs.10,37,482/- as compensation to the claimants along with interest @ 6% p.a. from the date of filing of the claim petition till realization of the entire amount.

Ms. Mozumdar has submitted that it has been proved by the appellant insurer in the proceeding before the learned Tribunal that the owner-cum-driver of the offending vehicle did not possess a valid and effective driving licence.

Appeal is admitted for Hearing.

Let the LCR be called for.

Issue Notice returnable in 6 (six) weeks.

The appellant shall take steps for service of notice on the respondents by usual process as well as by registered post with AD within 3 (three) days.

List the case after six weeks.
