                                            ORDER

30-11-2021 Shri B. Baruah, learned counsel for the petitioner submits that the issue at hand has been decided in a bunch of writ petitions which has also been upheld by the Hon'ble Division Bench, amongst others i.e. W.A. No. 200/2021.

The petitioner, who is a Surveillance Worker, is aggrieved by the action of the respondent authorities in not allowing him to perform duties and he has also prayed for payment of arrear salaries.

Similarly, issue of discontinuance of Surveillance Workers as well as their termination were the subject matter of dispute in a number of writ petitions which were dismissed by the learned Single Judge.

Appeals were preferred, including W.A. 200/2021 and the Division Bench of this Court vide judgment and order dated 09.11.2021 while dismissing the appeal, as a matter of abundant precaution, has directed the respondent authorities to institute a Committee to look into the cases of those effective Surveillance Workers who claimed to have possessed genuine documents.

Shri Baruah, the learned counsel for the petitioner submits that a similar directions be issued in this regard.

Shri B. Gogoi, learned Standing Counsel, Health & Family Welfare Department does not oppose the said prayer.

In view of the aforesaid broad consensus arrived at in the Bar and also Page No.# 3/3

taking into consideration the judgment and order dated 09.11.2021 passed by the Hon'ble Division Bench, the present petition is disposed of by giving liberty to the petitioner to place the original records and documents before the Committee which shall be constituted in terms of the directions of the Hon'ble Division Bench.

It is further directed that in the event, the petitioner submits documents and records, the same would be considered and consequential steps be taken.

The writ petition accordingly stands disposed of.
