Heard the learned counsel, Mr. S. Saikia, appearing for the appellants.

The appeal is admitted for hearing upon the following substantial questions of law:

i. Whether the lower appellate court erroneously allowed the appeal reversing the finding of the trial court by overlooking relevant materials facts relating to right of easement of way under the provision of law which was not specifically pleaded in the plaint?

ii. Whether the learned appellate court below without proper appreciation of the evidence on record, reverse the judgment and decree of the learned trail court?

Issue notice to the respondents.

The appellants shall take steps for service of notice on respondents by registered post with A/D and by other usual process.

Call for the LCR.

List this matter after 4 (four) weeks, on a date to be fixed by the Office.
