Heard Mr. J. Ahmed, learned counsel for the appellant. Also heard Mr. B.J. Dutta, learned Addl. P.P., Assam appearing for the State/respondent No. 1 and Ms. B. Sarma, Page No.# 2/2

Perusal of the case record shows that by order, dated 13.03.2020 a report was called from the learned Sessions Judge, Cachar at Silchar as to whether the appellant had already satisfied the sentence imposed on him by the learned trial Court and if the learned Sessions Judge found that the appellant had already satisfied the sentence, he should be released forthwith with report to this Court. Accordingly, a report has been submitted by the learned Sessions Judge, Cachar, Silchar.

From the report of the Superintendent, Central Jail, Silchar dated 11.03.2020 it appears that the accused has already served out his period of sentence.

Mr. B.J. Dutta, learned Addl. P.P., submits that the accused has already been released from jail on 17.03.2020.

It may be mentioned that the learned Sessions Judge, Cachar, Silchar vide Judgment and Order, dated 23.09.2013, passed in Sessions Case No. 330/2010 arising out of Silchar P.S. Case No. 1035/2006 (Corresponding to G.R. Case No. 1944/2006) convicted the appellant under Section 304 Part II of the IPC and sentenced him to undergo R.I. for 3 years and to pay fine of Rs.3,000/- in default to suffer R.I. for 3 months.

As the appellant has already served out the sentence passed against him and released from jail on 17.03.2020, the instant appeal has become infructuous.

Accordingly, the criminal appeal stands closed as infructuous.

Let this order be brought to the notice of the Registrar (Judicial).

Send back the LCR.
