Heard Ms. N. Phukan, learned Standing counsel, Elementary Education Department, Assam for the respondent Nos. 1, 2 to 4. Also heard Mr. B. Gogoi, learned Standing counsel, Finance Department of the State for the respondent Nos. 5 & 6.

No representation on behalf of the petitioner on call though name of counsel for him has been reflected in the cause list.

It is seen that consecutively on the last two occasions i.e. on 23.01.2019 as well as on 11.01.2021, the petitioner remained unrepresented.

Matter pertains to the payment of arrear salary to the petitioner for the period from 01.12.2011 to 29.02.2012, whereas the petitioner has filed this writ petition on 21.12.2016 claiming for arrear salary for the said period.

The issue involved in this writ petition is already settled by a Division Bench judgment of this Court dated 30.05.2012 passed in WA No. 71/2007 reported in 2013 (2) GLT 1094.

In view of the above, this writ petition stands dismissed for non prosecution.
