The parties are represented by the learned counsel. By this interlocutory application u/s 5 of the Limitation Act, the applicant prays for condonation of delay of 43 days in preferring the appeal against the judgment and award dated 09-10-2018 passed by learned Commissioner, Workmen's Compensation, Guwahati, in W.C. Case No. 137/2006.

Mr. B.K. Jain, learned counsel for the respondent No. 1 submits that he has no objection in condoning the delay of 43 days in preferring the appeal.

Having considered the cause of delay shown in the application and also the submission of the learned counsel for the respondent No.1 that he has no objection in condoning the delay, the application is allowed and the delay of 43 days in preferring the appeal stands condoned.

Office to register the connected appeal and list for admission reflecting the name of Mr. B.K. Jain in the cause list as counsel for the respondent No. 1 in the appeal.
