1. Both these abovesaid petitions, being connected, are taken up together.

2. In CRL.M.C. 1292/2026, petitioners seek quashing of FIR No. 224/2017 dated 23.07.2017, under Sections 308/342/34 IPC, registered at P.S. Sonia Vihar.

As per the bare averments appearing in abovesaid FIR, the complainant i.e. Mr. Rajender @ Raju was returning home on 23.07.2017, when all the accused persons came on motorcycles and hit him on his head and dragged him to their office where even bullets were fired and some empty cartridges were, as alleged, put into the pocket of the complainant. Complainant also claimed that his mobile phone and some cash was snatched and he was attacked in the office also. Fact, however, remains that the police arrived at the spot and took him to the hospital and it was on the basis of abovesaid allegations that said FIR was registered.

4. There are five accused person in abovesaid FIR namely Amit Pandey, Anupam Pandey, Kuldeep Pandey, Pankaj Sharma and Bhupinder Singh. Charge-sheet has already been filed and charges have also been ascertained in the abovesaid matter.

5. The petitioners in CRL.M.C. 1413/2026 seek quashing of FIR No.223/2017 dated 23.07.2017, under Sections 323/336/452/427/201/506/34 IPC and Section 27 of Arms Act, 1959, registered at P.S. Sonia Vihar. The abovesaid FIR has been lodged on the basis of complaint made by Amit Pandey (accused/petitioner No.1 in CRL.M.C. 1292/2026) who, rather, claimed that when he and his friends, including Kuldeep and Pankaj, were

present at their office, several persons had forcibly entered their office and a scuffle took place. He claimed that there was previous enmity between the two parties and, in the abovesaid incident, he, alongwith Amit, Kuldeep and Pankaj received injuries. The abovesaid incident resulted in registration of said separate FIR in which charge-sheet has been filed and the learned Trial Court has taken cognizance for some additional penal sections also.

6. It is informed that both the parties have entered into amicable settlement.

7. Copy of Memorandum of Understanding (MoU) dated 21.11.2025 has also been placed on record.

As per such MoU, both the parties are residing in the same vicinity and, with the help of common well-wishers, all disputes have been mutually settled and the parties have undertaken to live peacefully. It is also mentioned therein that the settlement has been taken place by both the sides without any fear, force and coercion from any corner whatsoever.

In terms of such settlement, the complainant-party in the respective matters have given their 'no objection' to the quashing of respective FIRs, while also undertaking that they would appear physically before the Court, at the time of consideration of the quashing petitions, and would make appropriate statements.

10. The respective complainants in the abovesaid two matters are present in Court and have been duly identified by their respective counsel.

When asked, respondent No.2-Mr. Rajender in CRL.M.C. 1292/2026 and respondent Nos. 2 to 6 in CRL.M.C. 1413/2026, reiterated the terms of such settlement as well as the facts mentioned in their respective affidavits. Both the parties submit that they are left with no grievance against each other

and would have no objection if the respective FIRs are quashed.

12. Learned counsel for both the parties submit that neither of the accused persons are having any other criminal involvement of any nature whatsoever.

13. It is also informed that, so far, no witness has entered into the witness box in either of the abovesaid matters.

14. In view of the settlement arrived at between the parties, continuing with criminal proceedings would serve no useful purpose. In any case, even the complainants in FIRs in question do not wish to press any charges against each other.

15. Accordingly, exercising inherent powers vested in this Court under Section 528 of the BNSS, it is deemed appropriate to quash the FIRs in question.

16. Consequently, to secure the ends of justice, FIR No. 224/2017, under Sections 308/342/34 IPC and FIR No.223/2017, under Sections 452/323/336/427/506/34 IPC, both dated 23.07.2017 and registered at P.S. Sonia Vihar, along with all consequential proceedings emanating therefrom, are hereby, quashed subject to petitioners of both the cases depositing cost of Rs.10,000/- each with Delhi High Court Staff Welfare Fund [Account no. 15530110074442: IFSC UCBA0001553] within two weeks from today..

17. The petition stands disposed of in aforesaid terms.

18. Pending application also stands disposed of in aforesaid terms.
