J U D G M E N T (oral)
1. Petitioner seeks quashing of FIR No.0653/2025 dated 20.12.2025, registered at P.S. Amar Colony, for commission of offences under Sections 318/316/340(2) of Bharatiya Nyaya Sanhita (BNS), 2023 (corresponding Sections 415/405/471 IPC), along with all consequential proceedings arising therefrom, on the basis of compromise arrived at between the parties.
2. The matter pertains to a dispute concerning installation of windshield in a Mercedes Car of complainant (respondent No.2 herein) and the matter has amicably been settled.
3. Earlier, when the contents of the petition were perused, there were certain facts which were not looking appropriate and learned counsel for the
petitioner prayed for short date to place on record amended petition and additional affidavit.
4. Amended petition has already been filed. Though, the additional affidavit is on record but during the course of consideration, learned counsel for the petitioner submitted fresh affidavit of the petitioner. The additional affidavit, filed today by the petitioner, also contains apology of the applicant and he has also deposed that he would not file any complaint or cross-case related to the issue in hand.
5. Such affidavit is taken on record and copy, thereof, has also been supplied to learned counsel for respondent No.2.
6. Learned Counsel for respondent No.2 reiterates that the matter has been amicably settled.
7. When the present matter was taken up by this Court on 26.02.2026, respondent No.2 had submitted that he would have no objection to the quashing of the FIR, subject to petitioner making necessary corrections in the present petition.
8. A 'no objection' certificate has also been submitted from the side of respondent No.2, which is also taken on record.
9. Respondent No.2 has joined the proceedings through video-conferencing today also and reiterates that he has entered into the settlement out of his own free will, without any coercion and influence from any corner whatsoever and therefore, he would have 'no objection' if FIR in question is quashed.
10. Learned counsel for respondent No.2 submits that in view of the amicable settlement, even the respondent No.2 would not file any further case in relation to grievance raised in the FIR or anything connected thereto.
11. Investigating Officer (I.O) is present in Court and identifies respondent No.2.
12. Keeping in mind the overall facts of the case and the fact that parties have amicably settled their all disputes, continuing with criminal proceedings would serve no useful purpose.
13. Accordingly, exercising inherent powers vested in this Court under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023, it is deemed appropriate to quash the instant FIR.
14. Consequently, to secure the ends of justice FIR No.0653/2025 dated 20.12.2025, registered at P.S. Amar Colony, for commission of offences under Sections 318/316/340(2) of Bharatiya Nyaya Sanhita (BNS), 2023 (corresponding Sections 415/405/471 IPC), along with all consequential proceedings arising therefrom, is quashed subject to petitioner depositing total cost of Rs. 20,000/- with Delhi State Legal Services Authority (DSLSA) within four weeks from today. Proof of deposit of cost be submitted in the Registry of this Court within further two weeks.
15. The petition stands disposed of in aforesaid terms.
16. The pending application also stands disposed of in aforesaid terms.
