                                                 JUDGMENT

1. Appellant impugns order dated 10.04.2023 whereby appellant has been held guilty of breach of order of the Court as well as the undertaking given to the Court with regard to the payment of maintenance and other dues in respect of the respondent-wife and the children.

2. Learned counsel for the respondent under instructions submits that even as on date, a sum of Rs. 7,09,166/- is due and payable to the respondent besides a sum of Rs. 18,900/- payable to the school i.e. Delhi Public School, Siddharth Vihar.

3. Appellant who is present in person in Court undertakes that he shall clear the entire arrears of Rs. 7,09,166/- payable to the respondent within a period of four weeks from today. A cheque in the sum of Rs. 4 lakhs in favour of the respondent drawn on Axis Bank Ltd. has been handed over in Court today. He undertakes that the cheque shall be honoured on its presentation. He undertakes that balance amount of Rs. 3,09,166/- shall be directly deposited in the account of the respondent on or before 21.09.2023. He further undertakes that he shall directly pay to the school the fee demanded by them for the children totaling to Rs. 18,900/- within three days from today. He further undertakes that he has taken out a Mediclaim Policy for the family including the respondent and the two children and shall continue to keep them insured in future also without making any claim for re-imbursement of the insurance premium amount. He further undertakes that he shall pay all charges demanded by the school towards school fee, bus charges and other dues and expenses incurred by the children for their education directly to the school authorities as soon as the same are demanded by the school and furnish a copy of the receipt to the respondent immediately on payment of the said amount.

4. Appellant further undertakes that he shall continue to pay the maintenance amount as directed by the Courts and also pay all charges demanded by the school directly to the school. The undertakings are accepted.

5. Appellant who is present in Court expresses remorse at his conduct and tenders an unconditional heartfelt apology. The apology is accepted.

6. Learned counsel for the respondent also states that on the undertaking given by the appellant and his complying with the same in future, he also has instructions not to press the contempt petition any further.

7. Appellant is bound down by the undertaking given to the court as well as given today in Court. Subject to the appellant complying with his undertakings and continuing to pay the amounts as undertaken towards the school charges, maintenance, arrears, etc., the appeal is disposed of and the surety bonds are discharged.
