                                                      JUDGMENT

MANMOHAN, J: (Oral) The hearing has been done by way of video conferencing. CM APPL. 30566/2021 Keeping in view the averments in the application, the same is allowed and the matter is restored to its original status.

Accordingly, the application stands disposed of. W.P.(C) 684/2020

1. Present writ petition has been filed seeking transfer of the petitioner from Bangalore Division, South Western Railways to Northern Railways, Delhi Division, on the ground that the petitioner's spouse is posted in Delhi.

2. During the pendency of the writ petition, the petitioner's representation seeking his transfer to Delhi on the "working couple" ground has been disposed of on the ground that the petitioner's wife is now posted at Asansol, West Bengal.

3. Keeping in view the aforesaid development, the writ petition along with pending application is disposed of with a direction to the petitioner to file a representation seeking transfer to Asansol, West Bengal on the "working couple" ground with respondent No. 2 and Director-General, Railway Protection Force, within a week, with an advance copy to learned counsel for the respondents. In the event, the said representation is filed within the stipulated period, the respondent No. 2 is directed to dispose of the said application within two weeks thereafter by way of a speaking order in accordance with law. Needless to state that in the event the petitioner is aggrieved by the said decision, the petitioner shall be at liberty to file appropriate proceedings in accordance with law.

4. The order be uploaded on the website forthwith. Copy of the order be also forwarded to the learned counsel through e-mail.
