Exemption is allowed subject to all just exceptions.

BAIL APPLN. 233/2019

1. Petitioner seeks interim bail in FIR No.542/2016 under Sections 376/354(B)/354/323/508 IPC, Police Station Ranhola on the ground that his mother requires an urgent surgery.

2. It is contended that the mother of the petitioner is suffering from Vaginal Cystocoel and requires an urgent total hysterectomy.

3. Medical documents have been produced. The same have been verified. As per the medical documents produced, the mother of the

petitioner could not be admitted in hospital as there was no one to attend to her. The surgery is now scheduled for tomorrow, i.e., 06.02.2019. It has also been verified by the Investigating Officer that the mother of the petitioner resides alone and there is no other person or member of family to take care of her.

4. Keeping in view the totality of the facts and circumstances, I am of the view that petitioner is entitled to interim bail for a period of three weeks.

5. Accordingly, on petitioner furnishing a bail bond in the sum of Rs. 25,000/- with one surety of the like amount to the satisfaction of the Trial Court, petitioner shall be released on interim bail for a period of three weeks from the date of his release. Petitioner shall not do anything which may prejudice either the trial or the prosecution witnesses.

6. Petitioner shall also mark his presence before the Duty Officer, Police Station Ranhola on every Monday morning. Petitioner shall also intimate to the Investigating Officer the date and time of the admission of the mother of the petitioner with regard to the surgery. Petitioner shall surrender to the concerned Superintendent, Jail on expiry of the period of three weeks of the date of his release.

7. The petition is disposed of in the above terms.

8. Order Dasti under signatures of the Court Master.
