JUDGMENT
SANJEEV SACHDEVA, J. (ORAL)
1. Petitioner seeks Regular bail in FIR No. 632/2018 under Sections 279/337/304-A of the Indian Penal Code, Police Station Punjabi Bagh, New Delhi.
2. Subject FIR was registered consequent to an accident that took place involving the car alleged being driven by the petitioner. The offending vehicle was being driven at a very high speed. It hit a two-wheeler and then hit a divider and thereafter overturned on the opposite side and hit another vehicle and overturned on the third car. One lady lost her life whereas three persons were injured.
3. MLC of the petitioner showed a very high level of intoxication.
4. Learned counsel for the petitioner submits that the petitioner is a young girl of 22 years of age and doing her graduation and has clean antecedents. Further, it is submitted that the petitioner has been in custody since 12.11.2018. Investigation is concluded and charge sheet has already been filed.
5. Learned Addl. PP submits that the driving licence of the petitioner has already been impounded and has been deposited with the Court.
6. Keeping in view of the totality of the facts and circumstances and the fact that petitioner is a young girl of 22 years of age and has clean antecedents and also that the investigation is complete and trial is likely to take some time, I am satisfied that the petitioner has made out a case for grant of regular bail.
7. Accordingly, on petitioner furnishing a bail bond in the sum of Rs.50,000/- with one surety of the like amount to the satisfaction of the Trial Court, petitioner shall be released on bail if not required in any other case. Petitioner shall not do anything which may prejudice either the trial or the prosecution witnesses. Further, Petitioner shall not drive any vehicle pending trial.
8. The petition is accordingly allowed in the above terms.
