SANJEEV SACHDEVA, J. (ORAL) Crl. M.A. 12522/2018 (Exemption) Allowed, subject to all just exceptions.

CRL.M.C. 3446/2018

1. The petitioner seeks quashing of FIR No. 1155 of 2015 under Sections 354-D/506/509 of the IPC registered at Police Station Neb Sarai, Delhi, based on a settlement.

2. The subject FIR was registered on an allegation that the petitioner- accused was known to the complainant and was pressuring the respondent

no. 2 to get married with him.

3. It is informed that subsequently the petitioner and respondent no. 2 have got married on 27.09.2015.

4. Respondent no. 2 is present in court in person and is identified by the Investigating Officer. Respondent no. 2 submits that she has settled the disputes with the petitioner and is agreeable to the settlement and does not wish to press the criminal charges against the petitioner any further.

5. In view of the fact that the disputes between the petitioner and respondent no. 2 have been settled and they have married each other and are residing together, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace is restored; securing the ends of justice being the ultimate guiding factor. It would be expedient to quash the subject FIR and the consequent proceedings emanating there from.

6. In view of the above, the petition is allowed. FIR No. 1155 of 2015 under Sections 354-D/506/509 of the IPC registered at Police Station Neb Sarai, Delhi and the consequent proceedings emanating there from are quashed.

7. Order Dasti under signatures of the Court Master.
