                             JUDGMENT

03.08.2018 SANJEEV SACHDEVA, J. (ORAL)

1. Petitioner impugns order dated 14.12.2017 of the family court whereby the application filed by Respondent no. 1 under section 125 Code of Criminal Procedure, 1973 has been allowed.

2. Parties were referred to the Delhi High Court Mediation & Conciliation Centre. Parties have settled their disputes. Mediation settlement agreement dated 18.07.2018 (also bearing the date 20.07.2018) has been executed between the parties.

2. Petitioner as well as respondent No.1 are present in court in person. They confirm that they have settled their disputes and they further undertake that they shall abide by the terms and conditions of the mediation settlement. Their undertaking is accepted.

3. As per the terms of the settlement, two demand drafts: one in the name of Krishna Uppal in the sum of Rs.72,000/- dated 16.02.2018 and the other in the name of Anjali Uppal - respondent No.1 in the sum of Rs.48,000/- dated 21.02.2018, both drawn on Punjab National Bank (totalling Rs.1,20,000/-) which stand deposited with the Trial Court shall be released in favour of the respondents respectively. As the names on the demand drafts have to be changed and they have also lapsed, the subject demand drafts shall be returned to the petitioner and thereafter fresh demand drafts shall be prepared in the following manner:-

(i) Rs.72,000/- in the name of Priyansh Yadav (the name of the son - Krishna Uppal).

(ii) Rs.48,000/- in the name of Anjali Yadav, the maiden name of respondent No.2.

4. The demand draft in the said sum of Rs.72,000/- shall be encashed and a fixed deposit receipt shall be made in the name of the minor son under the guardianship of the mother.

5. Parties pray that the petition be disposed of in view of the

mediation settlement.

6. Petition is disposed of in terms of the Mediation Settlement Agreement dated 18.07.2018 (also bearing the date 20.07.2018). Mediation Settlement Agreement shall form part of this order. Parties shall remain bound by the terms of the same.

7. Order Dasti under the signatures of the Court Master.
