1. Appearance is entered by learned counsel for the respondent No.3/Axis Bank, who states that he has received a complete set of the paper book. He also informs the Court that he has been nominated by Axis Bank to henceforth receive advance copies of petitions filed in the High Court and he shall take steps to communicate the same to the Registry.

2. Counsel for the respondents No.1 and 2 states on instructions that the investigation in respect of the petitioner has concluded and an intimation to this effect shall be communicated to the respondent No.3/Bank within this week so that the respondent No.3/Bank can permit the petitioner to make withdrawals from his account and liquidate the collaterals offered to the

respondent No.3/Bank, if required.

3. Mr. Tiku, learned Senior Advocate appearing for the petitioner states that the aforesaid action of the respondents No.1 and 2 has caused immense hardship to the petitioner as he has not been able to service the interest on the overdraft facilities extended to him by the respondent No.3/Bank that runs into lakhs of rupees. He reserves the right of the petitioner to seek legal recourse against the respondents, if necessary.

4. Without expressing an opinion on the fallout of the instructions given by the respondents No.1 and 2 to the respondent No.3/Bank in respect of the bank account of the petitioner maintained with the respondent No.3/Bank, the present petition is disposed of alongwith the pending application. The petitioner shall be at liberty to seek legal recourse against the respondents, if so advised.
