CRL.M.C. 2987/2017

1. Notice. Learned APP for the State, who appears on an advance copy, accepts notice.

2. The petitioner has invoked the writ jurisdiction of this court under Section 482 of the Code of Criminal Procedure, 1973 (in short 'Cr.PC') for quashing of FIR No. 260/2014 registered against him on 03.06.2014 under Sections 354/354(B)/323/506/509 of IPC, P.S. Subzi Mandi, New Delhi on the complaint of respondent No.4.

3. Notice to respondents No. 2 to 4. They are present in the court and accept the notice. They are duly identified by the Investigating Officer.

4. As per the allegations in the FIR while the complainant/respondent No.4 along with her niece, younger sister and husband of her sister namely Satish @ Sonu were returning to home after attending the trial against Madan Lal @ Badal before the court in Tis Hazari, an altercation took place at about 02.30 PM near Kamla Nehru Park. This resulted into registration of the said FIR on 03.06.2014.

5. The parties have amicably settled the matter. The matter had been settled between the petitioner and the respondent No.2 on 19.05.2016 before learned Mediator, Delhi Mediation Centre, Tis Hazari Courts, Delhi. The matter between the petitioner and respondent No.4 was settled before the Mediator, Delhi Mediation Centre, Tis Hazari Courts, Delhi, on 17.08.2016.

6. The complainant/respondents no. 2 to 4, who are present in court, submit that they have amicably resolved their disputes. They submit that they do not want to pursue the FIR. They submit that the said FIR may be quashed.

7. Since the respondents No.2 to 4 and the petitioner are residing in the same colony and the fact that the matter has been amicably settled between the parties and no purpose would be served in further pursuing with the said FIR and hence, to secure ends of justice and to have peace in the society, the FIR No. 260/2014 registered against him on 03.06.2014 under Sections 354/354(B)/323/506/509 of IPC, P.S. Subzi Mandi, New Delhi and proceedings arising out of the same

are hereby quashed.

8. The petition is disposed of.
