1. The suit has been placed before the Court in view of the

submission made by the counsel for the plaintiff that the parties have

arrived at an out of court settlement. On the said date, none was

present on behalf of the defendant.

2. Today, counsels for the parties jointly state that they have

arrived at an out of court settlement, whereunder the plaintiff has

transferred his 50% share in the suit premises in favour of the

defendant for consideration.

3. In view of the aforesaid submission, counsel for the plaintiff

seeks leave to withdraw the present suit, to which the other side has

no objection.

4. Accordingly, the suit is dismissed as withdrawn, alongwith the

pending applications, while leaving the parties to bear their own

expenses.
