1. The case has been placed before the Court by the Joint

Registrar, who has recorded in the order dated 13.03.2015 that none

had appeared on behalf of the plaintiffs and on the previous date of

hearing, i.e., on 16.10.2014, the presence of Mr. Ajay Amitabh

Suman, Advocate had wrongly been recorded for the plaintiffs whereas

he was appearing for the defendants. It has also been noted by the

Joint Registrar that the plaintiffs have not paid the costs imposed on

them on 10.09.2013.

2. The case was passed over on the first call to await the presence

of the plaintiffs/their counsel. On the second call also, none is present

on behalf of the plaintiffs. The records reveal that the plaintiffs have

not been appearing or producing the witness, whose affidavit by way

of evidence has been filed. It appears that the plaintiffs are not

interested in prosecuting the present suit, which is accordingly

dismissed in default and for non-prosecution.
