1. The record of CS (OS) No.2255/2010 has been received. Learned counsels have been heard on this appeal and the record perused.

2. The appellant assails the order dated 28th August, 2014 whereby the learned Single Judge has dismissed IA No.9929/2014 filed by the appellant/plaintiff seeking recall of the order dated 18th March, 2014 whereby his right to lead evidence was closed. As a result, the learned Single Judge has also, by the same order, dismissed the suit for want of evidence supporting the plaint.

3. The facts giving rise to the present suit are within a narrow compass. For the purposes of convenience, we refer to the parties by their nomenclature in the suit.

4. The appellant/plaintiff had filed CS (OS) No.2255/2010 against the respondent/defendant praying for recovery of money and damages of Rs.50,000/-. The following issues in the suit were framed by an order dated 16th July, 2012:-

“1. Whether the defendant had mis-represented to the plaintiff as alleged in para 18, 19 & 20 of the plaint? OPP

2. Whether the plaintiff had always been ready and willing to perform his part and agreement between the parties? OPP

3. Whether the suit is barred by limitation? OPD

4. Whether the plaintiff committed breach of agreement between the parties as alleged? OPD

5. To what amount, if any, the plaintiffs entitled from the defendant? OPP ”

5. The court directed filing of affidavits by way of evidence within four weeks. This period of four weeks’ time granted by the court to file affidavit of evidence expired on 16th August, 2012 without the plaintiff complying with the order. A second opportunity was granted to the plaintiff on 27th August, 2012 when two weeks’ time to file the list of witnesses and affidavit of evidence was granted. This period expired on 10th September, 2012 again without filing of affidavits.

On the 22nd of January, 2013, the plaintiff appeared in person and a third opportunity was granted to him to file a list of all witnesses and affidavits within eight weeks in the interest of justice. This period also expired on 20th March, 2013 without the plaintiff filing even the list of witnesses.

On the fourth occasion when the matter was listed on 1st August, 2013, the counsel who appeared for the plaintiff sought an adjournment on the ground that he had misplaced his file and that the plaintiff was out of station. This adjournment was opposed on behalf of the defendant. The learned Joint Registrar noted that the matter was adjourned on the previous date as well. In these circumstances, a last opportunity was granted to the plaintiff to file his evidence subject to payment of costs of Rs.5,000/- which were directed to be deposited with the Delhi High Court Legal Services Authority. Even this order did not persuade the plaintiff to bring his evidence on record. Not even the list of witnesses has been filed by the plaintiff. The plaintiff has till date not deposited the costs which were imposed by the order dated 1st August, 2013.

8. On the fifth date of hearing fixed on 19th December, 2013, the plaintiff was fortunate as the Joint Registrar was on leave and the matter was simply adjourned to 18th March, 2014. Despite some fortuitous opportunities available to the plaintiff to file the list of witnesses as well as affidavit and even to seek extension of time in accordance with law, the plaintiff failed to file the same. Costs remain unpaid.

9. The 18th March, 2014 was the sixth date of hearing for the same purpose. The plaintiff appeared in person. The learned Joint Registrar noted that no steps had been taken by the plaintiff in compliance with the previous order. In these circumstances, the right of the plaintiff to lead evidence was closed. The defendant was permitted to lead evidence on affidavit and granted six weeks to file list of witnesses with examination-in-chief of the witnesses.

10. It is noteworthy that a period of one year and nine months had by now passed since 16th July, 2012 when issues were framed in the suit and the plaintiff was first given an opportunity to file a list of witnesses and evidence.

11. This order motivated the plaintiff to take some steps, though belatedly. On the 6th May, 2014, the plaintiff filed IA No.9929 of 2014 purporting to be an application under Section 151 of the C.P.C. seeking recall of the order dated 18th March, 2014. This application renders no explanation as to why the list of witnesses or the evidence could not be filed despite six opportunities. It renders no explanation as to why costs have not been deposited with the Delhi High Court Legal Services Authority as ordered on 1st August, 2013. To say the least, the application is simplistic in the explanation rendered and dumps the entire blame for the above non-compliances on his counsel. The following explanation is to be found in paras 8, 9 & 10 of the application:-

“8. That on 4th April, 2014, the Plaintiff himself applied the certified copy of the order dated 18th March, 2014 and certified copies of the written statement and documents filed by the Defendant to enable him to re-construct his case file.

9. The Certified copies of the order dated 18th March, 2014 and certified copies of the other documents was received by the Plaintiff on 25th April, 2014.

10. That delay in filing of the affidavit of evidence is not the fault of the Plaintiff but due to the misplacement of file by the advocate of the Plaintiff.”

12. Interestingly, the plea that the file was misplaced in the office of the plaintiff in the third week of July without specifying any date is not tenable. Mr.Abhimanyu Mahajan, learned counsel appearing for the respondent submits that this explanation has been concocted to drag the litigation and to unduly harass the defendant who is 81 years old lady. It is pointed out that on 1st August, 2013, the plaintiff was represented by counsel.

We also find that so far as the submission that the entire file was lost is belied by the fact that on 4th April, 2014, when the plaintiff applied for certified copies, he had not sought certified copies of the plaint. It would appear that only certified copies of the order dated 18th March, 2014 and some other documents were sought for the purposes of filing of the application for recall. This would show that the plaintiff had copies of the plaint and other records.

The plaintiff claims to have knowledge that the file was missing from the third week of July, 2013, yet no steps at all have been taken by the plaintiff to re-construct the file or make a request for copies from the counsel from other side. We find substance in the submission of learned counsel for the respondent-defendant that the plaintiff has been wilfully and deliberately negligent in the matter and is not entitled to exercise of any discretion or indulgence in his favour and that the order dated 18th March, 2014 closing his right to defence was fully justified in the given circumstances.

The learned Single Judge has noted that the circumstance that the plaintiff has failed to deposit the costs; has neither sought extension to file the evidence or to pay the costs; has failed to file the list of witness and affidavit of witnesses even while filing IA No.9929/2014; that no affidavit of any counsel was enclosed with the application as well as the contention that the file was missing is belied by the fact that the plaintiff did not seek certified copy of the plaint. The circumstance that even after obtaining certified copy of the order dated 25th April, 2014, neither any application for extension of time for doing so nor the evidence has been filed, have also weighed with the learned Single Judge while concluding that no grounds were made out to recall the order dated 18th March, 2014.

16. Mr. Abhimanyu Mahajan, learned counsel appearing for the respondent has submitted before us that on a search conducted on the Delhi High Court website, he could trace out the following cases which were filed by or against the appellant:-

17. It is submitted that the first case filed by the present appellant/plaintiff which could be traced out was filed by him in the year 2000. It is submitted by learned counsel for the respondent-defendant that this list of cases would show that the plaintiff was not a novice and was an experienced litigant who was fully aware of his rights as well as the procedural requirements. It is submitted that the High Court website shows that he mostly appeared in person in prosecuting or defending his case. IA No.9929/2014 was also filed by the plaintiff in person. The record of the suit also shows that the plaintiff was appearing in person before the court. In this background, the plaintiff was well conversant with the requirements of law and cannot be permitted to fasten the fault of his own wilful negligence upon counsel who was conducting his case.

The appellant had failed to file his evidence despite six opportunities spreading over a year and a half. He also disclosed no valid or sufficient reason for not having done so.

18. The order dated 28th August, 2014 dismissing IA No.9929/2014, therefore, cannot be faulted in the factual matrix or on any legally tenable grounds.

As a result, for the reason that the plaintiff had failed to file the list of witnesses as well as the affidavit of evidence despite these opportunities, the plaintiff having failed to produce any evidence, the learned Single Judge had no option but to proceed under Order XVII Rule 3 CPC The parties were present in court. The court had no option but to decide the suit forthwith. As the plaintiff had failed to establish his case, the suit had to be dismissed. The judgment of the learned Single Judge dismissing the suit is, therefore, in accordance with law.

20. The plaintiff has been negligent throughout the proceedings and has been penalized for his own deliberate wrongs. He has wilfully delayed the proceedings in the suit and has adopted dilatory tactics for repeatedly seeking adjournment without any justification. The defendant has vehemently protested that the suit was malafide, barred by limitation and filed only to harass her at the age of eighty years.

21. For all these reasons, we are of the view that the plaintiff is liable to be burdened with heavy costs.

The appeal is, accordingly, dismissed with costs which are quantified at Rs.50,000/-.
