1. Vide the present petitioner, the petitioner seeking initiation of proceedings against the respondent for violating and not complying the order dated 21.12.2012 passed in W.P.(C) No 8086/2012.

2. Learned counsel appearing on behalf of respondent Nos. 1 and 2 submits that letter dated 02.03.2013 and thereafter reminders dated 28.03.2013 and 07.05.2013 have been sent to the General Secretary/Principal, Hindu Shiksha Samiti, D.A.V. Sr. Secondary

School No.2, Shankar Nagar, Delhi, however, no response from their end.

3. Learned counsel appearing on behalf of respondent No.3 submits that respondent No.3 has already communicated pursuant to the communications sent by respondent Nos. 1 and 2, and to this effect, he may produce the report. Moreover, the inquiry officer has been appointed and inquiry is in progress and the petitioner is not joining the inquiry.

4. The petitioner is present in person and does not dispute the statement made by the counsel for respondent No.3 and seeks liberty to withdraw the present petition with liberty to challenge the appointment of enquiry officer.

5. Liberty granted as prayed.

6. Accordingly, the petition is dismissed as withdrawn.

7. Consequently, the contempt notice stands discharged.
