02. 07.1.2014 Heard learned counsel for the petitioners
and learned counsel for the State.
This application under Section 482 Cr.P.C.
for quashing of the order dated 10.10.2012, passed by
the learned Asst. Sessions Judge, Cuttack, in S.T.
No.189 of 2012, directing issue of N.B.W.As against the
accused persons-petitioners.
Considering the submission made and
keeping in view the findings of the trial Court as given
in the impugned order, I do not find any justification to
interfere with the impugned order. However, in the
event the petitioners surrender before the learned Asst.
Sessions Judge, Cuttack, in S.T. No.189 of 2012, within
two weeks hence and move for bail, they shall be
released on bail on such terms and conditions as the
learned Asst. Sessions Judge may deem just and
proper.
CRLMC is accordingly disposed of.
Issue urgent certified copy as per rules.
