Amandeep Singh Chadda & Others vs State Of Uttarakhand & Others
2014 Latest Caselaw 3822 Del

Citation : 2014 Latest Caselaw 3822 Del
Judgement Date : 20 August, 2014

Delhi High Court
Amandeep Singh Chadda & Others vs State Of Uttarakhand & Others on 20 August, 2014
WPMS No. 2322 of 2013
Hon'ble Alok Singh, J.

Mr. Rakesh Thapliyal, Advocate for the petitioners.

Mr. R.C. Arya, Standing Counsel for the State.

In a meeting held on 01/02/2011, Regional Transport Authority has decided to grant permits in favour of the petitioners for the routes, in question, with the stipulation that permits were to be lifted within two months.

It is stated by the learned counsel for the petitioners that permits could not be issued by the Authorities despite repeated visits and requests, therefore, petitioners moved applications for extension of time to lift the permits. In a meeting held on 15.12.2012, Regional Transport Authority has decided to constitute a Sub-committee to consider the applications of the petitioners for the extension of time to lift the permits.

Learned counsel for the petitioners vehemently argued that despite the meeting dated 15.12.2012 to constitute a Sub- committee to consider the applications of the petitioners for the extension of time to lift the permits, Sub-committee has not taken any decision on the applications seeking extension of time to lift the permit despite the fact that petitioners were heard long before.

Mr. R.C. Arya, learned Standing Counsel, appearing for the State, submits that Sub-committee as well as Secretary, Regional Transport Authority shall take appropriate decision on the applications of the petitioners for the extension of time to lift the permits, in question, preferably within three weeks from today.

In view of the statement made by the learned Standing Counsel, present petition thus stands disposed of with the direction that Secretary, Regional Transport Authority as well as Sub-committee shall take appropriate decision on the applications of the petitioners for extension of time to lift the permits, in question, in any case, within four weeks from today.

(Alok Singh, J.) Dated 20.08.2014 Shiv
