SURESH KAIT, J. (Oral)

1. Vide the instant petition, petitioner has assailed the judgment dated 26.05.2011 and order on 29.06.2011 respectively passed by ld. Trial Court and Appellate order dated 30.01.2012.

2. Ld. Counsel for the petitioner on instruction has submitted that petitioner is ready to pay the entire amount to respondent by way of six installments and further undertakes to clear all the dues on the amount by August, 2012.

3. Ld. Counsel appearing on behalf of respondent no. 2 has agreed as stated by ld. Counsel for the petitioner.

4. I further note here that petitioner is present in person and the statement made by the Counsel is on his instructions.

5. Ld. Counsel for the petitioner further submits that since the

matter has been compromised and stands compounded, therefore, the judgment and order referred above passed by ld. Trial Court and the order of ld. Appellate Court may be set aside.

6. Keeping the statement of the petitioner and the counsel for respondent no. 2, judgment and order dated 25.06.2011 and 29.06.2011 respectively passed by ld. Trial Court and the judgment dated 30.01.2012 passed by the Appellate Court are hereby set aside.

7. Here, I make it clear that if the petitioner fails to comply with the order, then he will suffer the remaining sentence.

8. Crl. Rev.P. 70/2012 is allowed and disposed of.

9. In view of the order passed in Crl. Rev.70/2012, Crl. M.B. 294/2012 does not require further adjudication and the same is disposed of.
