1. By this appeal filed under section 96 of the Code of Civil Procedure, 1908 the appellant seeks to set aside the judgment and decree dated 30.7.2009 whereby the suit for declaration and recovery filed by the appellant was dismissed.

Facts of the case shorn of unnecessary details are that the appellant is a registered partnership firm running Bharat Petroleum Retail outlets and had two electricity connections i.e. K.No 80225 & 11055. The appellant had also applied for an additional load of 45 KW vide letter dated 30.7.02. That on 1.8.02 a team of the respondent conducted an inspection and found overload in excess of the sanctioned load and thus imposed misuse charges. Later the respondent sanctioned the additional load as requested by the appellant on 25.9.02. The appellant vide letters dated 11.10.02 and 22.10.02 sought withdrawal of misuse charges but to no avail. The respondent had conducted a second inspection on 30.10.02 when the load was found to be within the sanctioned load and thus the appellant sent a legal notice dated 29.08.05 for refund of the misuse charges. But due to inaction of the respondent the appellant filed a suit for recovery and declaration which vide judgment and decree dated 30.7.2009 was dismissed. Feeling aggrieved with the same, the appellant has preferred the present appeal.

Assailing the impugned judgment and decree passed by the learned trial court, counsel for the appellant submits that the respondent-NDMC failed to prove the inspection report and in the absence of the same the learned trial court ought to have believed the case as set up by the appellant in the suit. Counsel for the appellant further submits that the inspection report dated 01.08.2002 had taken into consideration even those appliances which were merely installed but were not put to use. Counsel for the appellant also submits that the learned trial court failed to appreciate that the appellant had immediately lodged a protest against the inspection report dated 01.08.2002 by writing a letter dated 11.10.2002. Counsel for the appellant also submits that the respondent had also failed to supply copy of the first inspection report dated 01.08.2002 and in the absence of the copy of the inspection report the appellant could not exactly come to know what appliances were taken into consideration by the respondent while levying the misuse charges. Based on the above submissions, counsel for the appellant submits that the impugned judgment passed by the learned trial court is illegal and perverse on the very face of it and deserves to be set aside.

4. Opposing the present appeal, learned counsel appearing for the respondent supports the impugned judgment. The counsel submits that the judgment passed by the learned trial court is a well reasoned judgment and the same deserves to be upheld.

5. I have heard learned counsel for the parties at a considerable length and gone through the records.

It is not in dispute between the parties that on the date of the first inspection, i.e., 01.08.2002 the sanctioned load of the two electricity connections installed at the premises of the appellant was 83.30 KW. The appellant has also not disputed the fact that it had installed more appliances and to meet the requirement of those appliances, the appellant had also applied for the sanction of additional load of 45 KW on 30.07.2002. On the date of the alleged inspection by the Inspecting Team of the respondent on 01.08.2002, it was found that the actual connected load being used by the appellant was around 141.744 KW and there was a specific mention of connected CNG Booster Motor of 22 KW. The appellant herein has disputed the correctness of the said inspection report, but nowhere has the appellant disputed the correctness of the appliances which were mentioned in the said inspection report. The appellant was also found taking inconsistent stands by taking two self contradictory positions, i.e., one by saying that the inspection report was prepared by the respondent at their office and on the other hand, admitting the fact of the said inspection carried out by the team of the respondent on 01.08.2002. It also cannot be lost sight of the fact that the appellant took more than two months in lodging the protest against the said inspection report. The plea of the counsel for the appellant is that the copy of the inspection report was not available with the appellant. This plea of the counsel does not inspire any confidence as had it been so, nothing stopped the appellant from obtaining the copy of the said inspection report from the concerned office of the respondent. Another factor which cannot be ignored is that the appellant itself had applied for sanction of additional load of 45 KW and the appellant has admitted the fact that certain appliances were already re-installed in the premises but the same were not yet put to use. With the admission of installation of the additional appliances and also the fact that the appellant had applied for grant of additional load of 45 KW which, in fact, was later on granted by the respondent, the onus was on the appellant to prove that it had not yet put the appliances to active use. In the absence of any evidence led by the appellant on this aspect, the irresistible conclusion is that the appellant, in fact, had started using the said additional appliances without even waiting for the sanction of additional load. In any event of the matter, the appellant failed to produce any cogent evidence to dislodge the correctness and authenticity of the inspection report dated 01.08.2002.

7. In the light of the foregoing, I do not find any illegality or perversity in the impugned judgment. There is no merit in the present appeal and the same is hereby dismissed.
