1. On the suggestion given by the respondent-discom, the matter was passed over to enable the petitioner to consider whether the mater can be settled on the terms suggested.

2. Learned counsel for the petitioner states that the proposal given by the respondent-discom is acceptable and the petitioner agrees to settle the impugned bill raised by the respondent-discom pursuant to inspection dated 5th October, 2009 on payment of Rs.45,000/-, which shall be paid in six equal monthly installments. The first installment will be paid on or before 10th April, 2010 and the last installment will be paid on or before 10th September, 2010.

3. On payment of the first installment, the electricity supply in the premises of the petitioner will be restored but in case there is failure to pay any subsequent installment or future electricity bills, the respondent-discom will be at liberty to disconnect the electricity supply. In case the petitioner does not pay any installment, original bill shall stand revived and the respondent-discom will be also entitled to initiate proceedings under the provisions of the Electricity Act, 2003. On full and final payment of Rs.45,000/-, as stated above, the entire claim of the respondent-discom pursuant to inspection dated 5th October, 2009 shall be settled.

4. The petitioner will be also entitled to ask for separate electricity connection in respect of the shop. If any such application is made, the same will be disposed of expeditiously and preferably within a period of seven days without insisting on payment of the impugned bill pursuant to inspection dated 5th October, 2009, except payment of the installments as stated above.

The writ petition is accordingly disposed of.

Copy of this order will be given dasti to the learned counsel for the parties.
