ORDER
This petition under Section 34 of the Arbitration & Conciliation Act,
1996 has been filed assailing an award published on 9th August, 2007 by the
learned Arbitrator. The petition was filed on 12 th March, 2008. The period for
filing objections against the award is three months. Three months' period expired
on 9th November, 2007. The petition could have been filed along with an
application for extension of time maximum by thirty days in terms of Section
34(3) of the Arbitration & Conciliation Act 1996, latest by 9th December, 2007.
The petition is therefore barred under Section 34(3) of the Arbitration &
Conciliation Act, 1996 having not been filed within the period prescribed and is
liable to be dismissed on this ground.
The petition is hereby dismissed.
