JUDGMENT
Madan B. Lokur, J.
1. This is a petition under Section 9 of the Arbitration and Conciliation Act, 1996 (the Act).
2. The dispute in this case arises out of an agreement No. 6/99-2000 dated 31st January, 2000 between the parties.
3. The Petitioner had filed Arb. Petition No.71 of 2004 under Section 11 of the Act for the appointment of an Arbitrator.
4. By judgment and order delivered by me today, I have held that this Court has no territorial jurisdiction to entertain the disputes between the parties under Section 11 of the Act. Consequently, the interim measure granted by this Court also would not survive. However, since this Court had entertained this petition, the interim order passed on 30th December, 2003 will continue for a period of four weeks from today to enable the Petitioner to approach the appropriate forum for redressal of its grievances.
5. With the above observations, the petition is disposed of.
