ORDER
Rule.
1. With the consent of Counsel for the parties I propose to dispose of the petition.
2. The present petition is directed against the failure to the respondent No. 2, Director of Education, in taking action against respondents 3 and 4 on the complaint of the petitioner dated 13th September, 2002.
3. The petitioner's son Arjun Singh Pawha was admitted in Delhi Public School, Dwarka in Class VII in the academic year 1999-2000. The respondent No. 2 School at the time of admission requested the petitioner to part with Rs. 40,000/- as loan. The said respondent school had promised to refund the said amount to the petitioner at the time of leaving of his child from the school.
4. The petitioner had withdrawn his son from the school in April, 2001. The petitioner made repeated requests to the respondents to pay him the said sum of Rs. 40,000/-. As the petitioner received no response from respondents 3 and 4, he filed a complaint with the respondent No. 2 on 13th September, 2002 in this regard. The matter is pending before the respondent No. 2 and no action has been taken on his complaint.
5. Having regard to the facts and circumstances of the case the respondent No. 2 is directed to dispose of the complaint of the petitioner by way of a speaking order within four weeks from today. A reasonable opportunity of hearing shall be afforded to the petitioner.
No further orders are called for in this petition. The same stands disposed of. dusty to Counsel for the parties.
