Shrivastava, learned counsel for the petitioner. Also
heard Mr. Shashank Thakur, learned Dy. Advocate
General, appearing for the State/respondent No.1 and
Mr. Trivikram Nayak, learned counsel for appearing for
respondent No.2 / CGMSC.
Learned counsel for the petitioner submits that
Clause 3.2.10 and Clause 3.3.2 of the present tender
impose a blanket ban based on any past blacklisting,
suspension, or criminal/civil proceedings at any time,
irrespective of relevance, context, or subsequent
acquittal, thereby introducing unreasonable
disqualifications wholly alien to fair tendering norms.
He further submits that adverse consequences of
blacklisting cannot be indefinite and must cease once
the prescribed debarment period has lapsed. In
support of his contention, he placed reliance on the
judgment passed by the Division Bench of High Court
of Delhi at New Delhi in the matter of MI2C Security
Facilities Pvt. Ltd. Vs. North Delhi Municipal
Corporation and Others (2021 SCC Online Del
3682).
