Heard Shri Shobhit Koshta, counsel for the appellants. Also heard Shri Sangharsh Pandey, GA for the State.

Learned counsel for the appellants would submit that in the present case, appellants- 1 to 9 are languishing in jail for the last 10 years as their bail application was dismissed as withdrawn by this court vide order dated 07.07.2021, whereas, appellants- 10 to 36 have been granted bail. It is further submitted by learned counsel for the appellants that one of the co-accused Ghassu, appellant in CRA-699 of 2021 has also been granted bail by the co-ordinate Bench of this Court on 01.02.2022, and he was directed to appear before the Registry of this Court on 20.03.2023, on which date he also appeared. This appellant is also represented by Shri Shobhit Koshta, Cra 879 of 2020 and 699 of 2021

Advocate.

In view of the same, and all appellants in CRA-879 and 699 are represented by Shri Shobhit Koshta, Advocate, though appellants-10 to 36 are on regular bail, appellants-1 to 9 are languishing in jail since last 10 years; and the sole appellant in CRA-699 of 2021 is also on bail, represented by the same Advocate, and he states that he is ready to argue these cases finally, therefore, this Court may proceed to hear these cases finally.

Probably Registry of this Court taking plea that the accused/appellants-10 to 36 in CRA-879 of 2020, who have been granted bail have not appeared before the Registry of this Court after being released on bail, listed the case for non- appearance of the appellants, but all the accused/appellants are represented by Shri Shobhit Koshta, Advocate, and hence, we proceed further and heard these cases finally.
