Also heard on I.A. No.01/2025, application seeking suspension of sentence and grant of bail to Appellants No.1 & 2.
By the impugned judgment dated 15.07.2025 passed by learned Additional Sessions Judge(Fast Track Court) Surajpur, District Surajpur (C.G.) in Sessions Case No.18/2022, whereby Appellants No.1 & 2 have been convicted and sentenced as under:-
Conviction Sentence & fine 324/34 of IPC RI for 6 months and fine of Rs.
1000/- each, in default, 1 months' additional RI
Learned counsel for the appellants submits that this appeal is only filed for Appellant No.1 & 2. Appellant No.3 died during pendency of trial and as he was made shown to be the accused before the Trial Court, hence his name has been shown in cause-title of this appeal. He further contended that maximum jail sentence awarded to Appellants No.1 & 2 is of 6 months. The appellants 1 & 2 suffered jail sentence of
about 14 days during trial thereafter they were on bail during trial and not misused the liberty granted in their favour. The appeal is likely to take time to be finalized, therefore, the substantive jail sentence imposed upon Appellants No.1 & 2 may be suspended during pendency of this appeal and they may be released on bail.
On the other hand, learned State counsel opposes the bail application.
On due consideration of submissions of learned Counsel appearing for the parties and further considering the short sentence awarded to Appellants No.1 & 2 of 6 months only, the application (IA no.01/2025) is allowed.
It is directed that the substantive jail
shall be suspended till final disposal of this appeal and they shall be released on bail on their executing a personal bond for a sum of Rs. 25,000/- each with one surety for the like sum to the satisfaction of the trial Court for their appearance before the Registry of this Court on 13th October, 2025. They shall thereafter appear before the concerned trial Court on a date to be given by the Registry of this Court and shall
continue to appear before the trial Court on all such subsequent dates as are given to them by the said Court till disposal of this petition.
Call for record of the Trial Court.
List this case after 8 weeks.
