Mr. Himanshu Kumar Sharma, Panel Lawyer for the State/respondent. By the impugned judgment dated 16.05.2022 passed by the learned Special Judge (FTSC) POCSO Act Mungeli, District- Mungeli (C.G.) in Special Criminal Case No. 59/2018, the appellant stands convicted, as under:-

                      Conviction                                  Sentence
              U/s 8 of POCSO Act         : R.I. for 3 years and fine of Rs. 2000/- in default
                                           of payment of fine S.I. for two months.

Learned counsel for the appellant would submit that the appellant has been granted bail vide this Court's order dated 11.11.2022, but he could not furnish the bail due to financial crises, therefore, he is still in jail. He would further submit that the appellant is unable to furnish surety as directed by this Court on 11.11.2022, therefore, the appellant may be released on bail on executing a personal bond only.

Learned State counsel has no objection.

Considering the fact that the appellant is unable to furnish the surety as directed by this Court on 11.11.2022, it is directed that the appellant shall be released on bail on his executing a personal bond in sum of Rs. 25,000/- to the satisfaction of trial Court for his appearance before the Registry of this Court on 14th February, 2023. He shall thereafter appear before the trial Court on a date to

be given by the Registry of this Court and shall continue to appear there on all such subsequent dates as are given to him by the said court till the disposal of this appeal.

A copy of this order be communicated to the jail authorities. List this appeal for final hearing in its chronological order.
