This appeal is admitted on the following substantial question of law :-
"Whether finding of the lower appellate Court holding that defendants
No. 2 to 6 (Kapoorvilas, Bhagvati, Kaushalya, Humesh and Gopalkrishna),
who were born from the wedlock of Premlal and his concubine - Munni Bai,
are not entitled to inherit any interest over the coparcenary property (suit
property), is perverse ?"
Issue notice to respondents No. 1 to 21 only, on payment of P.F. as per rules.
Counsel for the appellants is directed to supply the substantial question of
law as framed to the counsel for the State/respondent No.22 within a period of 15
days from today.
Also heard on I.A.No.01/2021, an application for grant of stay.
Issue notice of this application also to the said respondents, as above.
Meanwhile, purely as an interim measure, it is directed that the effect and
operation of the impugned judgment and decree dated 08.02.2021 passed by the
Additional District Judge, Pathalgaon, Dist. Jashpur, in Civil Appeal No. 8-A/2019
shall remain stayed till the next date of hearing subject to appellants' furnishing
security amount of Rs.25,000/- before the concerned Executing Court within a
period of 60 years from today.
Post this matter after 5 weeks for consideration on I.A.No.01/2021.
