Heard Mr. Rudranath Mukharjee, learned counsel for the appellant.

2. This writ appeal is presented against an order dated 13.09.2021

passed by the learned Single Judge in WPS No.1543 of 2012.

3. There is a defect in array of parties.

4. In that view of the matter, Mr. Mukharjee prays for withdrawal of this

writ appeal with liberty to file a fresh appeal and other applications which

are filed along with the present appeal.

5. Ms. Astha Shukla, learned Government Advocate submits that having

regard to the array of parties in the writ petition, she can appear only for

respondent No. 1 in this appeal. She does not oppose the prayer made by

Mr. Mukharjee.

6. Accordingly, the writ appeal is disposed of with liberty as prayed for.

7. Registry will return back certified copy of the impugned order, if

prayed for by the appellant.
