This is first bail application under Section 439 of CrPC. The applicant has been arrested in connection with Crime No.791/2021 registered at Police Station Sarkanda, District Bilaspur, C.G. for the offence punishable under Sections 363, 366, 376 Indian Penal Code and Sections 4 & 6 of POCSO Act.

2. Parents of the victim/prosecutrix appeared before this Court and raised they have no objection.

3. Counsel for the applicant seeks permission of this Court to withdraw this bail application on the ground that the case is posted for judgment.

4. Permission as prayed for is granted.

5. Bail application is dismissed as withdrawn.
