1. Heard application praying for grant of leave to file criminal appeal against the impugned judgment in Sessions Trial No.10/2021, passed by the learned Sessions Judge, Jashpur, District: Jashpur on 27.09.2021 acquitting all the respondents.

2. Heard the submissions made by the counsel for the applicant. After considering on the submission and perusing the copy of deposition file along with the petition, we are of the view that the application is fit to be allowed only with respect to respondent No.1. There is no ground present against respondent No.2 and 3 for prosecution of acquittal appeal against them. Hence, the application is partly allowed.

3. Leave is granted to file acquittal appeal against respondent No.1 alone.

4. Registry is directed to register the acquittal appeal against the respondent No.1.

5. Accordingly, the instant petition is disposed of.
