                    Heard on Cr.M.P. followed by acquittal appeal preferred
              against the judgment dated 12.06.2019 passed by the learned
              Judicial Magistrate First Class, Takhatpur District - Bilaspur (C.G.) in
              Complaint Case No. 109/2019 whereby and whereunder learned trial
              Court acquitted the accused of charge framed under Section 138 of
              Negotiable Instruments Act.
                     On due consideration, this Court is of the view that special
              leave to appeal may be granted. Consequently, the present Cr.M.P.
              is allowed. Registry is directed to list the matter under the head of
              acquittal appeal.
                    Record of the Court below be called.
                     On petitioner's paying process fee within 10 days, notice along
              with a copy of acquittal appeal be issued to the respondent through

registered and usual mode, returnable within 4 weeks.

List the matter for further hearing after service to respondent is complete and record is available.
